Job Description
We are in search of a seasoned and highly proficient Head of Compliance to spearhead our expanding digital asset services venture in Malaysia. The incumbent in this role will be tasked with crafting and executing a robust compliance and anti-money laundering (AML) strategy, ensuring the company's strict adherence to all pertinent laws, regulations, and guidelines within the digital asset services sector. The Head of Compliance will play a pivotal role in fostering a culture of unwavering compliance and will serve as a primary point of contact with regulatory authorities.
Key Responsibilities
Regulatory Compliance:
... - Formulate, implement, and uphold a comprehensive compliance framework in strict accordance with Malaysian laws, regulations, and guidelines concerning digital asset services, which includes adherence to the Guidelines on Prevention of Money Laundering and Terrorism Financing for Digital Asset Service Providers set forth by the Securities Commission of Malaysia, as well as AMLA and FATF standards.
- Stay abreast of regulatory alterations and assess their potential impact on the company's operations.
AML and CFT Program:
- Supervise the development and management of the company's AML/CFT program, overseeing the formulation and execution of appropriate policies, procedures, and controls.
- Take charge of client onboarding processes, ongoing due diligence, and transaction monitoring protocols.
- Conduct risk assessments and establish a risk-based approach to AML and CFT protocols.
Reporting and Monitoring:
- Establish and maintain a robust transaction monitoring system, capable of detecting and reporting suspicious activities to relevant authorities.
- Prepare and submit punctual and precise compliance reports to senior management and regulatory bodies.
Training and Awareness:
- Provide regular training sessions for employees and relevant stakeholders on compliance and AML/CFT matters.
- Cultivate a pervasive culture of compliance, ensuring all staff members comprehend and fulfill their compliance responsibilities.
Internal and External Communication:
- Act as the primary liaison with regulatory authorities and auditors on compliance and AML/CFT issues.
- Collaborate with internal stakeholders to ensure seamless coordination and effectiveness of the compliance program.
Risk Management:
- Identify and evaluate compliance and AML/CFT risks within the organization, devising strategies for risk mitigation.
Policy Development and Implementation:
- Develop and update compliance and AML/CFT policies and procedures to align with regulatory requirements.
- Ensure the efficacious implementation of these policies across the organization.
Relationship with Regulators:
- Serve as the principal contact point for regulatory authorities, managing inquiries and inspections.
- Foster constructive relationships with regulators and remain abreast of regulatory evolutions.
Training and Education:
- Deliver comprehensive training to employees and management on regulatory compliance matters, fostering a resolute culture of compliance within the organization.
Job Requirements
Educational Qualifications:
- Bachelor's degree in Finance, Law, Business Administration, or a related field. Possession of a postgraduate degree is advantageous.
Professional Certifications:
- Preferred certifications include Certified Anti-Money Laundering Specialist (CAMS) or Certified Compliance Professional (CCP).
Experience:
- A minimum of 2 years of hands-on experience in compliance and AML/CFT roles.
- A minimum of 3 years in a managerial capacity, reporting directly to the Board, Risk Committee, Chief Risk Officer (or equivalent) in compliance and AML/CFT roles.
- Preferred experience within the custodian services, financial services industry, or the digital asset sector.
- Demonstrated success in developing and implementing compliance and AML/CFT programs.
Regulatory Knowledge:
- Thorough comprehension of the regulatory landscape governing digital asset services in Malaysia, including familiarity with the Guidelines on Prevention of Money Laundering and Terrorism Financing for Digital Asset Service Providers and FATF guidelines.
Leadership Skills:
- Strong leadership and management capabilities, with the aptitude to lead and cultivate a compliance team.
Analytical Skills:
- Excellent analytical acumen, enabling the identification and assessment of compliance risks and the formulation of appropriate solutions.
Communication Skills:
- Effective communication and interpersonal proficiencies for liaising with internal and external stakeholders.
Integrity:
- A commitment to upholding the highest ethical standards and ensuring the integrity of the company's operations.
